1. INTRODUCTION

Siena is committed to protecting your privacy. We provide this Privacy Policy to explain the type of information we collect and to inform you of our specific practices and guidelines that protect the security and confidentiality of personal information, including protected health information (“PHI”) that individually identifies you or others and that is subject to the Personal Data Protection Act 2012 (PDPA). This Privacy Policy does not apply to any website or application operated by third parties. Use of the Platform is governed by this Privacy Policy and our Terms of Use. If any term in this Privacy Policy is unacceptable to you, please do not use the Platform. This Privacy Policy may be updated periodically and your continued use of the Platform after changes are made is deemed to be your acceptance of those changes.

Siena knows that protecting the privacy and confidentiality of your personal information is important. We will only collect information where it is necessary for us to do so and if it is relevant to your interactions with us, in the manner set out in this Privacy Policy. We will only keep your information for as long as it is relevant for the purposes for which it was collected.

2. COLLECTION, USE AND DISCLOSURE OF PERSONAL DATA

Depending on the nature of your interaction with us, some examples of personal data which we may collect from you include: 

  • Your name, identification number, mailing address, email address, contact number, nationality, date of birth, billing and collection information that you provide to us, information related to your eligibility, or any other information collected on the Platform that is defined as personally identifiable information under applicable law (“Personal Information”).
  • If you are using the telemedicine service, we require you to upload a photo of your NRIC or Passport. This is to ensure our health care partners are able to perform identity verification during the teleconsultation, so as to comply with National Telemedicine Guidelines. Siena will not use the image of your NRIC for any other purposes.
  • Personally-identifiable health-related information which you provide to us and which is prepared by health care providers who provide healthcare services and products to you via our Platform, including information relating to your health history, medical claims, laboratory testing results, diagnostic images, photographs and any other information exchanged in interactions between you and Siena or the health care providers and their professional entities.
  • Information about the computer or mobile device you are using to access our Platform, and geographical location or address.
  • Other information which you may input into the Platform or related services.​

We collect information directly from you when you provide it to us, as well as from third parties if you use any websites or social media platforms operated by third parties (e.g., Facebook, Instagram, medical blogs etc.)

Our platform uses “cookies” to better understand how you use our platform and to improve your experience. An example would be recalling a set of preferences you have selected for Siena’s website. Storing cookies on your web browser allows us to present you with custom web pages and other content that are tuned with your preferences. Unless you have set your preferences so that you will be alerted when a cookie is being stored on your computer, you will not know about it. If you are concerned about cookies, you may disable them by adjusting the privacy and security settings of your web browser. ​​However, if you disable cookies, you may not have the optimal experience.

We may disclose personal data that we collect or you provide as follows:

  • For treatment, payment, and/or health care providers that provide any services to you.
  • To Siena’s and its affiliated professional entities’ employees, or other third parties who provide services to Siena or an affiliated professional entity.
  • To third-party credit card processors so that they can process any payments by you.
  • To third-party service providers for the fulfilment of your orders, including logistics and packing needs. 
  • To any third parties we believe necessary or appropriate to comply with applicable laws.
  • For any other purpose disclosed by us when you provide the information or with your consent.
  • To any legal, regulatory, governmental, tax, law enforcement or other authorities or the relevant right owners.
  • Siena may disclose your personal information to parties connected with the contemplated or actual financing, insuring, sale, assignment or other disposal of all or part of its business or assets, including for the purposes of determining whether to proceed or continue with such transaction or business relationship or fulfilling any records or other reporting requirements to such parties.

3. HOW WE PROTECT YOUR INFORMATION

Siena maintains reasonable physical, electronic and organisational measures to protect your data against unauthorised or unlawful access, misuse, disclosure, alteration and destruction. Whilst we endeavor to keep all information secure through commercially accepted means such as encryption and organisational security safeguards, we cannot guarantee absolute security of all information. You are responsible to keep your user account and passwords secure by taking suitable measures to prevent unauthorised usage or access by unauthorised persons. Siena cannot be held liable for any inappropriate use of user account names and passwords carried out by any user. In the event that information is compromised and we are aware of it, reasonable steps will be taken to investigate and notify the affected users and other various actions may be taken including notifying the respective legal authorities and law enforcement agencies. 

4. RIGHTS ON PERSONAL DATA 

For any request on information relating to the collection, use and storage of your personal data by us, please contact us at [email protected]. Nonetheless, you may choose what personal data you wish to provide to us. If you choose not to provide certain information, usage of some or all of our services may be affected. Subject to the jurisdiction, you have the ability to choose what to do with your personal data (i.e. access, correction, removal, objection, portability, etc.) and may raise a request by email to [email protected] if assistance is required. We will handle such requests in accordance with applicable law, and may charge a reasonable administrative fee to cover the costs of responding to any such request.

5. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed in accordance with the laws of Singapore. Any claims or disputes arising out of or relating to the use of this Platform shall be subject to the exclusive jurisdiction of the courts of Singapore. Use of this Platform is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this paragraph. If any part of these Terms is found to be invalid, illegal or unenforceable by a court, the validity of the remaining provisions will not in any way be affected or impaired. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. 

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity or termination, shall be referred to and resolved by arbitration administered by the Singapore International Arbitration Centre in accordance with the Arbitration Rules of the Singapore International Arbitration Centre for the time being in force, which rules are deemed to be incorporated by reference in this Clause.

6. AMENDMENTS TO PRIVACY POLICY

We may revise this Privacy Policy from time to time at our sole discretion. All changes shall be effective immediately upon posting to this page unless otherwise mentioned and the effective date will be noted at the beginning of this Privacy Policy. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to use the Services after the new Privacy Policy takes effect.

7. ADDITIONAL CONSIDERATIONS

Our Services are not directed to individuals under 18. We do not knowingly collect Personal Data from children under 18. If we become aware that a child under 18 has provided us with Personal Data, we will take steps to delete such information.
